ABUSE OF AUTHORITY / ABUSO DE AUTORIDAD

This was a complete ABUSE OF AUTHORITY against a resident foreigner for the "crime" of walking his old adopted rescue dog on the beach at dawn, and whose dog was injured by representatives of Zihuatanejo's municipal authority. This ambush was orchestrated by the director of DIMAREN, Israel Campos, and a so-called Eco-guardian named María Augustina, whose job is likely a reward for participating in political campaigns and who appears to be seeking to please her boss with too much enthusiasm. Why didn't they simply fine him? Why did they need all the weapons and physical force? The Municipal Police don't even go after real criminals with such enthusiasm. It appears that racism is part of the equation here.

Please read the details of the encounter in the notes on the YouTube page.

I'd like to see how the municipal government responds before suggesting any further action. Israel Campos needs to be fired. That would be one logical demand to make. Another is to of course demand that the stupid Blue Flag rules be rescinded. The entire Blue Flag scam is like buying a trophy and saying you won a tournament. If the point is to protect the environment, all they're doing is creating a worse environment. If they absolutely need to pay an outsider to tell them how to keep our beaches healthy and get a "merit badge" for it, then Playa Platino is a much better program to follow for achieving their stated goal.

But I still believe this is all about discrimination against dogs and their owners.

The great President of Zihuatanejo was instrumental in having this stupid ruling put in place from the beginning. She must be watching too much Fox Entertainment coverage of the US coverage of the mass deportations and how the police agencies have turned to Gestapo methods. The local police should be preventing real crime in the community not bothering people with their dogs on the beach. I was approached by the police when I was walking my dog on the malacon and I told him that I wouldnt let my dog on the beach because of all the garbage left by people and it was too dirty for my dog

After watching the video, I am appalled. Two heavily armed police to deal with someone walking a dog on leash? They should be working to prevent real crime. In our experience, there are always several dogs walking on the beach in the morning. I wonder why this particular dog and owner were singled out. We know the dog and owner involved, they pose no threat. The owner is assiduous in picking up waste when needed.

Oh, the growing list of cops caught on camera abusing their authority.
2 minutes of total power in exchange for years of ridicule in cyberland.
My favorite is Officer Joffrion telling Jeff Gray he can't hold a sign saying "God Bless the Homeless Vets" in Mississippi because it's "not a free will state." Echoes of Descartes, or was it William James, in reverse.

The rise of authoritarian strongmen tactics is happening all over the globe. We have seen this movie before. It does not end well. Our near global future looks bleak. As one historian of the Pre-World War II era recently said bluntly, "The lesson of the 1930's is to get out early."

Looking to buy in Zihuatanejo in the next year or so...

I saw on one of the Facebook groups that it was the owner of La Perla that reported him to the police. Not that it will make a difference to his business, but I will keep this in mind when I chose businesses to patronize.

He has been known publicly as a dog hater for years. However his younger brother Javier, who I think runs the bars, is very much a dog person.

We gave up La Perla as soon as we heard about Francisco's feelings about dogs.

We thought it was the ecologia employee, Maria Augustina who called the police.

Are you implying white people are targeted and not welcomed in Zihuatanejo simply because they are white? Not good if true.

I don't want a dogfight. I have and have had many dog family members.

Rules are rules regardless if we agree with them.

Let's not sensationalize this event or imply racism for what appears a person who was forewarned of expectations and for whatever reason felt above these expectations. Hopefully he didn't feel this way simply for being white.

Shoot, haven't people been banned from this Forum for breaking the rules?

Again, I don't want a dogfight and I would also love to have my canine companion with me as I enjoy the beach. But I understand and reluctantly accept the rules.

Let's hope our 4 legged best friend is fine and their "owner" (ironic on Juneteeth) considers his best friend on future decisions.

People continue to be killed and kidnapped in the Zihuatanejo area.

Let's hope things get better in the area.

Damn. Much respect to this gentleman for standing up to the man for something many believe in. The lying about assaulting the cops is so typical of Mexican LE and does not by any means pertain to only southern Mexico or impoverished areas. I've been on the receiving end of their bullshit and 'ATTEMPTED" shake down a few times. Abducting the dog is another new low.

I wondered about the “racism” aspect as well.

I have a Scandinavian parent and a Celtic parent, but surprisingly I tan like nobody’s business. One time I was flew into LAX and the immigration officer gave me a bad time. They said, “You look Mexican to me.” I thought they had no idea how ignorant that was.

My experience has been that Mexicans’ “race” spans from the whiter-than-white to the blacker-than-black. There is a woman at the Cafe de Atoyac coffee vendor who looks like she would fit in selling coffee in Dublin.

Similarly, extranjeros, including those from the USA and from Canada \, come in all shades of all races. I wonder whether what was meant was xenophobia, a form of prejudice characterized by the dislike, fear, or hatred of people perceived as outsiders or foreigners.

The perceived "racism" is against anyone that looks like a Gringo. It isn't about skin color.

Pets are family members, and discrimination against them is discrimination against all families with furry family members who visit or live here. The local government imposed this rule against the will of the community, including the owners and operators of beachfront lodgings and restaurants. We held a vote, and after telling us they would respect our vote, the municipal government betrayed us and tried to bullsh¡t the public with media campaigns. This Blue Flag policy has lost us residents and visitors, yet no one has been able to prove that we've received one single additional visitor because of it, even less enough people to justify the loss of tourists and residents and the public expense, since as usual, taxpayers foot the bill for the bad ideas of politicians.

Exactly. A dog on the beach on a leash, with an owner and poop bag ,is part of that family. No question, no doubt, no debate. The owner will protect that dog to the same degree as a child. The owner will expect the dog to behave like a member of the family. However, laws and rules are in place until we can get them changed and they should be complied with. It will take a very large march on city hall with all the dogs to get noticed.

Speaking of Dictators, take a look at Venezuela's Bolivar, plunging into nothingness by the hour as Maduro continues to rule the Banana Republic with an iron fist. I hear he's shutting down dollar-trackers now, hoping no one notices.
Like arresting the weatherman for showing the oncoming hurricane.

“The fierce repression began in June when they shut down websites publishing exchange rates and arrested 56 people, accusing them of trading dollars at unofficial rates,” Guerra said. “Then they arrested three well-known economists — including two from the National Academy of Economic Sciences and a university dean — and later detained two [observatory] associates, whose whereabouts remain unknown.”

edited by Little Guy, Sunday, June 22, 2025, 16:23

I can’t imagine the mayor or family being anti-dog. Their beagles ran around during ing a fund raiser to most everyone’s amusement.

A person can be a dog owner and also not be a responsible dog owner. I think of the number of dogs I have seen in Mexico tethered on a short lead for hours, in the sun, the rain, or even in tropical stormsi.

I think of the number of irresponsible dog owners who let their “furry children” out onto the street exposed to traffic and the number of dogs I see dead at the side of roads because of those irresponsible owners.

When I take my dog for walks (always with poop bags) on beaches we commonly see dogs unaccompanied. Even when accompanied, only once have I seen the human with dog poop bags.

The problems are not with responsible dog owners. The problems are with irresponsible dog owners.

The person in the video ought not to be vilified and penalized. They ought to be held up as an example of how people ought to behave.

But it appears that the “good burghers" of Zihuatanejo don’t care enough about dogs, dog ownership, or visitors to their beaches to require even the licensing of dog ownership. Not only are dog licenses not required, from as best as I can determine, dog licenses are not even available.

With dog licensing, responsible dog owners and their pets could enjoy their time together in paradise and irresponsible owners could be held accountable.

This man ought to be awarded, not arrested.

ABUSE OF AUTHORITY / ABUSO DE AUTORIDAD

by Andydlp, Tuesday, July 08, 2025, 00:14 (487 days ago) @ ZihuaRob

To obtain an **amparo** (constitutional protection) as a *civil society organization* (Asociación Civil) against a municipality like **Zihuatanejo** for banning **dogs on the beach**, you need to follow a legal process showing that:

1. The municipality overstepped its authority**, since beaches are federal property.
2. Your constitutional rights or legal interests were violated**, such as freedom of movement, legal certainty, or property rights.

---

Legal Basis

**Mexican beaches are public federal property**, regulated under:

* Artículo 27 de la Constitución
* Ley General de Bienes Nacionales
* Ley General del Equilibrio Ecológico y la Protección al Ambiente**

**Municipalities have no authority to legislate over federal land**, unless expressly delegated.

---

### ✅ Requirements to File an Amparo as a Civil Society (A.C.)

1. **Legal Standing (Interés Jurídico o Legítimo)**
Your civil association must demonstrate:

* A **direct, personal, and legitimate interest** in the use/enjoyment of the beach (e.g., promoting environmental or animal rights, beach activities, etc.).
* That **the rule or act affects your purpose or members**.

2. **Claim Against an Authority (Acto de Autoridad)**
The municipality of Zihuatanejo (or its officials) is acting **outside their competence** by enforcing rules on federal land.

3. **Proof of the Act or Norm**
This includes:

* Municipal circulars, rules, or enforcement practices that ban dogs.
* Any signage, fines, or police orders being enforced.

4. **Violation of Rights**
You must show how this ban:

* Infringes on federal law.
* Violates your organization’s purpose or your members' rights (e.g., right to a healthy environment, public access to federal property, freedom of movement, etc.).

---

### ???? Procedural Steps

| Step | Description |
| ---- | ----------------------------------------------------------------------------------------------------------------------------------------------- |
| 1. | **Gather evidence** of enforcement: photos of signs, official rules, witness testimonies, etc. |
| 2. | **Have your A.C. properly constituted**, with bylaws that support environmental or civic advocacy. |
| 3. | **File the amparo** through a constitutional lawyer in the **Juzgado de Distrito** in Guerrero. |
| 4. | Request a **suspensión provisional**, so the municipality cannot enforce the rule during the process. |
| 5. | Litigate the amparo through its phases: admission, informe justificado (response by the authority), audiencia constitucional, and final ruling. |

---

### ⚠️ Strategic Considerations

* Mention that **Blue Flag certification** has **no legal binding power** in Mexico, and **cannot justify a restriction** unless federal law supports it.
* Consider **citing jurisprudence** that says municipalities cannot limit access to federal beaches unless authorized.
* A court might reject your amparo if you don’t clearly show **harm** or **legal standing**, so it helps to include members or evidence of people directly affected.

---

### ???? Legal Tips

* Make sure the amparo is not *notoriamente improcedente* (clearly inadmissible).
* Cite **jurisprudencias** like:

* Tesis 2a./J. 143/2004: Sobre facultades de los municipios.
* Jurisprudencia de la SCJN: Las playas son bienes de uso común, no pueden privatizarse ni restringirse sin causa legal.

---

I says here it needs to be done in guerrero but it is not true as the beach is federal property you can do it in mexico city where the government of zihuatanejo has little influence.
