Right v Might
The Mexican Constitution has been described as ‘nominal’ versus the USA constitution as ‘normative’. The Mexican Constitution has no intended immediate congruency between its stated aspiration and reality.
The USA Constitution establishes norms which are expected to be followed by political and legal institutions. (Mexican Law, Oxford University Press, 2004, p 79).
Under the Mexican Constitution beaches are Federal property.
To be denied access to a beach - property of the Federal Government of Mexico - is a violation of a Revolution ideal as expressed in the Constitution.
¡Viva la Revolución, pero aún no ha terminado!
