I know the difference. There definitely have been 14th Amendment-based lawsuits based on DEI initiatives such as mandated "Diversity Statements" when applying for academic jobs, and other hiring practices.

This is the last I'll say in this protracted thread, but here's a thoughtful essay by a black woman from the American South who is happy to see DEI be done with, focusing on how this bureaucratic institution fails in advancing the core tenets of Civil Rights.
