Can anyone recommend a lawyer versed in real estate law? I may be selling a property without using a realtor and I want to make sure the process is followed correctly and I am protected.

Elder Guardino solved the problem for us but we still lost 50% of the 5 figures which was still 5 figures US just half the original amount.

A few weeks later, the seller agreed to our original offer. We have also used Agustin's services a couple of other times, without any problems. Bottom line: if I ask for a recommendation about services, merchandise, or whatever, I like to hear both the plusses and the minuses, which helps to make up my mind. Does Elder speak English?

Why do you keep repeating yourself on my Message Board especially after I politely ask you not to? Part of the reason I post any preferences about any local services is to try to steer folks away from using the services of people who have allegedly displayed unethical practices or who have allegedly benefitted from acts of corruption. Instead of repeatedly asking me to write down such things that could be used in a legal process against me, why can't you simply respect my judgement call on the matter? There is a lot that goes on in Zihuatanejo that you are unaware of and will likely remain blissfully so.

Does Elder speak English?

No reason for the sarcasm. Obviously Sidney and I have some history on this topic, and I shouldn't have to remind anyone over and over not to recommend services here that I believe have problems after having stated as much repeatedly, whether they be ethical issues or others. There are more than a few services I refuse to list because I know the money they used to build their business or service was obtained via corrupt means. Others I know who have clearly demonstrated a lack of good ethics that may not actually violate laws but surely offend the conscience and/or the spirit of the law. Then there are several folks I've seen recommended who simply are not what they pretend to be. My reputation here on my website is one based on my honesty. If you believe I'm not being honest then by all means seek advice elsewhere. I certainly make no claim to being an expert or omnipotent on anything. No one pays me to do this, and I would love to spend my time doing other things. I'm just trying to be helpful and honest. I know I sure as hell wouldn't want to do business with the people or services I don't recommend, but perhaps such questions of morals, principles and ethics don't bother some people and they would be just fine with it. I don't pretend to read minds or define what principles folks should adhere to. But I trust in the values my wife and I share, and here on my website I will insist they be respected.

Thanks for your evaluation but none of it applies. The sale was of our primary residence and being cap. gains tax emempt after 5 years of not using the exemption. Federal statute. In Zihuatanejo the requirements are tweaked a bit to force surprise and unnecessary tax levies. We have bought and sold in Tulum, Playa Del Carmen, Cancun and Merida. Not our first rodeo.

The rules are what they are and easily followed. However in Zihuatanejo a layer or addition or twist has been added to the tax exemption for foreigners that is never pointed out until the sale is in process and the seller either accepts it or follows the new stipulation and waits 6 months to sell. That of course puts the transaction in jepordy.

If this is not a complicated sale why get an Atty if your the seller. The Buyer assumes all risks here and is responsible for getting the paperwork correct at the Notario.

A simple signed agreement, deposit and your on the way. If you don't get paid you don't sign!

For the record NOTHING a relator does here is binding or legal. Anyone can call themselves a relator.

Many moons ago when San Diego actually had not one but two daily newspapers, one of them did a piece on lawyer jokes, inviting readers to send in their best. Couple weeks later, a letter was printed taking the paper to task for that feature. The writer went on at some length about the good things that attorneys do, worker's rights, criminal law, defending consumers against big uncaring corporations, etc. The writer revealed that their close relative had been an attorney--one of the good ones--for many years, but he was killed in a tragic accident when an ambulance backed over him.:-D :-D

*We should have lawyers shipped to Zihua for burial...a place with an apparently unlimited supply of concrete.
